Gallery Terms & Conditions

1. Ownership of Images

All photographs displayed in this gallery are the exclusive property of Ed Curthoys Photography. Copyright is retained by Ed Curthoys at all times, including after purchase. Purchasing an image grants you a licence to use that image under the terms set out below — it does not transfer ownership, copyright, or any other intellectual property rights.

No image may be reproduced, distributed, published, or used in any form without prior purchase and written agreement from Ed Curthoys Photography.

2. Proofing Galleries — Unpurchased Images

Images displayed in proofing galleries are provided for selection purposes only. The following are strictly prohibited in relation to any image that has not been purchased:

•       Downloading, saving, or copying any image by any means, including screenshots

•       Sharing, forwarding, or publishing any image on social media or other platforms

•       Cropping, editing, or removing watermarks from any displayed image

•       Using any image for personal, commercial, or promotional purposes

Watermarks are applied to all proofing images as a deterrent to unauthorised use. Removal or circumvention of watermarks is a breach of these terms and may constitute an infringement of copyright under the Copyright, Designs and Patents Act 1988.

3. Purchased Images — Permitted Use

Upon purchase, you are granted a non-exclusive, non-transferable licence to use the purchased image(s) for the following permitted purposes only:

•       Personal use, including printing for private display

•       Sharing on personal social media accounts, provided Ed Curthoys Photography is credited

•       Use in personal profiles, including dating apps, LinkedIn, and similar personal platforms

The following uses require a separate commercial licence agreement and are not included in a standard purchase:

•       Use in advertising, marketing materials, or promotional campaigns

•       Use by businesses, brands, or organisations in any capacity

•       Editorial publication, including press, magazines, or online media

•       Resale, sublicensing, or transfer to any third party

4. Credit & Attribution

Where images are shared online, credit must be given to Ed Curthoys Photography. Acceptable credit formats include: © Ed Curthoys Photography | www.bikephotos.co.uk, or tagging @bikephotosuk on the relevant platform.

5. Gallery Access & Expiry

Gallery access links are personal to the recipient and must not be shared publicly or passed to third parties without permission. Ed Curthoys Photography reserves the right to expire or remove gallery access at any time. Galleries will typically remain accessible for 30 days from the date of delivery unless otherwise agreed in writing.

Ed Curthoys Photography is not responsible for any loss resulting from the expiry or removal of a gallery. Clients are advised to complete their selections and purchases promptly.

6. Breach of These Terms

Any unauthorised use of images constitutes a breach of these terms and an infringement of copyright. Ed Curthoys Photography reserves the right to pursue appropriate remedies, which may include:

•       Issuing a formal takedown notice

•       Invoicing for retrospective commercial licensing at full market rate

•       Pursuing legal action for copyright infringement under UK law

Copyright infringement in the United Kingdom is governed by the Copyright, Designs and Patents Act 1988. Infringement may result in damages, legal costs, and injunctive relief.

7. Limitation of Liability

Ed Curthoys Photography shall not be liable for any indirect, incidental, or consequential loss arising from the use of, or inability to access, images in this gallery. Our total liability shall not exceed the purchase price paid for the image(s) in question.

8. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
